Kirac\u0131lar aydan aya \u00f6dedikleri miktarlar\u0131n ger\u00e7ek hayatla uzaktan yak\u0131ndan bir ilgi olmad\u0131\u011f\u0131n\u0131 d\u00fc\u015f\u00fcn\u00fcyor. Ev sahipleri ise y\u00fcksek enflasyonu g\u00f6sterip kiraya resmi zamm\u0131 yapacaklar\u0131n\u0131 s\u00f6yl\u00fcyorlar.<\/p>\n<p>T\u00fcrkiye\u2019de ev kiralar\u0131ndaki y\u0131llar art\u0131\u015flar yasalarla enflasyona endekslendi. Eskiden 12 ayl\u0131k \u00dcretici Fiyat Endeksi baz al\u0131narak yap\u0131lan bu art\u0131\u015flar dolar kurundaki art\u0131\u015ftan dolay\u0131 \u00dcFE ciddi y\u00fckseldi\u011fi i\u00e7in 12 ayl\u0131k T\u00dcFE ortalamas\u0131na g\u00f6re yap\u0131l\u0131yor.<\/p>\n<p>Yine de A\u011fustos ay\u0131nda ev sahibinin kiraya yapmaya hakk\u0131 olan yasal art\u0131\u015f miktar\u0131 y\u00fczde 15! Peki d\u00fcnyada durum ne? Ev sahipleri ile kirac\u0131lar neler ya\u015f\u0131yor?<\/p>\n<p><strong>BERL\u0130N SAB\u0130TLEM\u0130\u015eT\u0130 AMA&#8230;<\/strong><\/p>\n<p>Almanya\u2019n\u0131n ba\u015fkenti Berlin\u2019de kiralar\u0131n \u00e7ok y\u00fckselmesi sonucu Berlin\u2019deki apartman kiralar\u0131n\u0131n Haziran 2019\u2019daki seviyesine be\u015f y\u0131l boyunca sabitlenmesi karar\u0131 al\u0131nm\u0131\u015ft\u0131. Kas\u0131m 2020 itibar\u0131yla Haziran 2019 seviyesinin \u00fcst\u00fcnde olan kiralar\u0131n da bu seviyeye \u00e7ekilmesine karar verilmi\u015fti.<\/p>\n<p>Almanya M\u00fclkiyet Vakf\u0131\u2019n\u0131n hesab\u0131na g\u00f6re 2013-2019 aras\u0131nda ev kiralar\u0131nda y\u00fczde 27 art\u0131\u015f ya\u015fand\u0131. 2015 y\u0131l\u0131nda kiralar d\u00fc\u015f\u00fck kald\u0131\u011f\u0131 gerek\u00e7esiyle Berlin\u2019deki ev sahiplerine kiralara y\u00fczde 10 zam yapma hakk\u0131 tan\u0131nm\u0131\u015ft\u0131.<\/p>\n<p class=\"content-image\"><img decoding=\"async\" src=\"https:\/\/istanbulchannel.net\/wp-content\/uploads\/2021\/08\/kiracilar-isyanda-ama-her-ulkede-2.jpg\" alt><\/p>\n<p><strong>G\u00d6LGE ARTI\u015eLAR BA\u015eLADI<\/strong><\/p>\n<p>Berlin\u2019de ya\u015fayan ev sahipleri de kanunun etraf\u0131ndan dolanmak i\u00e7in ev kiralar\u0131 \u00fcst s\u0131n\u0131rda olmayan daireleri de uzun s\u00fcre zam olmayaca\u011f\u0131 i\u00e7in \u00fcst s\u0131n\u0131ra yak\u0131n bir noktadan kiral\u0131yorlard\u0131. Yani ayl\u0131k kiras\u0131 normal ko\u015fullarda 1000 euro olacak bir evi 3-4 y\u0131l zam olmayaca\u011f\u0131 gerek\u00e7esiyle 1500 euro\u2019dan kiraya veriyorlard\u0131. Piyasa uzmanlar\u0131 buna \u2018g\u00f6lge art\u0131\u015f\u2019 diyor.<\/p>\n<p>Almanya Anayasa Mahkemesi ise daha sonra verdi\u011fi kararda kira kontrol\u00fcn\u00fcn Almanya anayasas\u0131na ayk\u0131r\u0131 oldu\u011funa h\u00fckmederek bu karar\u0131 kald\u0131rd\u0131.<\/p>\n<p>Mevcut kanuna g\u00f6re Almanya\u2019da evde oturulan ilk d\u00f6rt y\u0131l ev sahibi ev kiras\u0131na y\u00fczde 20\u2019den fazla zam yapam\u0131yor.<\/p>\n<p><strong>350 B\u0130N \u0130MZA<\/strong><\/p>\n<p>Berlin\u2019de ev kiralar\u0131 \u00f6yle bir hal ald\u0131 ki 350 bin imza toplayan kirac\u0131lar \u00e7ok say\u0131da apartmana sahip ev kiralama \u015firketlerine devletin el koymas\u0131na ili\u015fkin referanduma gidilmesini istiyor. Bu \u015firketlerin kiralar ile keyfi bir \u015fekilde oynayabildi\u011fini s\u00f6yleyen kirac\u0131lar Eyl\u00fcl ay\u0131nda Berlin\u2019de sand\u0131k ba\u015f\u0131na gidecek. Referandumda karar ne \u00e7\u0131karsa \u00e7\u0131ks\u0131n mahkemeden d\u00f6nmesi bekleniyor.<\/p>\n<p>Almanya anayasas\u0131nda konutlar\u0131n gerekti\u011fi durumlarda kamula\u015ft\u0131r\u0131labilece\u011fi ifade ediliyor fakat daha \u00f6nce bu hi\u00e7 uygulanmad\u0131. Belediye yetkililerine g\u00f6re gayrimenkul \u015firketlerinin kent genelindeki m\u00fclklerinin piyasa de\u011feri 36 milyar euro.<\/p>\n<p>OECD verilerine g\u00f6re Almanya\u2019da ya\u015fayan insanlar\u0131n yar\u0131s\u0131 evlerini kiraya veriyor. Almanya d\u00fcnyada m\u00fclk sahipli\u011finin n\u00fcfusa oranla en fazla oldu\u011fu \u00fclkelerden biri.<\/p>\n<p>Sadece Almanya\u2019n\u0131n ba\u015fkenti Berlin\u2019de de\u011fil, Yeni D\u00fcnyan\u0131n merkezi New York\u2019ta da kirac\u0131lar ile ev sahipleri kar\u015f\u0131 kar\u015f\u0131ya.<\/p>\n<p><strong>D\u00d6RT YILDA ALTI KEZ K\u0130RA SAB\u0130TLEND\u0130<\/strong><\/p>\n<p>New York\u2019ta pandemi sebebiyle kiralar\u0131n d\u00f6rt y\u0131lda yedinci kez kurul karar\u0131 ile sabitlenmesi bekleniyor. Ev sahipleri evlerin bak\u0131m giderlerinin artt\u0131\u011f\u0131 gerek\u00e7esiyle sabitleme karar\u0131na kar\u015f\u0131. Kirac\u0131lar ise pandemi sebebiyle i\u015flerinin bozuldu\u011funu ve bu kiralar\u0131 \u00f6deyemeyeceklerini s\u00f6yl\u00fcyorlar.<\/p>\n<p>Kira Rehberi Kurulu\u2019nda kirac\u0131lar\u0131n temsilcisi olarak bulunan Sheila Garcia, \u201cBronx ve \u00e7evresinde ya\u015fayan insanlar i\u00e7in pandemi \u00f6ncesinde de kiralar\u0131n\u0131 \u00f6demek zordu, \u015fimdi bu zorluk aynen devam ediyor\u201d de\u011ferlendirmesinde bulundu. Kirac\u0131lar kiralar\u0131n y\u00fczde 3 d\u00fc\u015fmesini teklif etmi\u015f fakat bu komisyon taraf\u0131ndan reddedilmi\u015fti.<\/p>\n<p><strong>PANDEM\u0130 KAYNAKLI \u0130ND\u0130R\u0130M TALEP ED\u0130LEB\u0130L\u0130R M\u0130?<\/strong><\/p>\n<p>Pandemi s\u00fcrecinde kiralara ili\u015fkin durum T\u00fcrkiye\u2019de de tart\u0131\u015f\u0131lm\u0131\u015ft\u0131. Bursa 4\u2019\u00fcnc\u00fc B\u00f6lge Adliye Mahkemesi, pandemi sebebiyle kirada y\u00fczde 50\u2019lik m\u00fccbir sebep indirimi karar\u0131 vermi\u015fti. Karar\u0131 de\u011ferlendiren Hukuk\u00e7u Do\u00e7. Dr. Umut Yeniocak, \u201cEmsal bir karard\u0131r, pandemi \u015fartlar\u0131 gerek\u00e7e g\u00f6sterilerek i\u015fyeri kiralar\u0131nda indirim talepli uyarlama davalar\u0131n\u0131n a\u00e7\u0131labilece\u011fini g\u00f6rd\u00fck.
