Buna g\u00f6re y\u0131ll\u0131k izin g\u00fcnlerine denk gelen cumartesi de dahil hafta tatilleri y\u0131ll\u0131k izin s\u00fcresinden say\u0131lm\u0131yor.<\/p>\n<p><strong>NASIL DAVA KONUSU OLDU?&nbsp;<\/strong><\/p>\n<p>H\u00fcrriyet&#8217;ten Noyan Do\u011fan&#8217;\u0131n haberine g\u00f6re Yarg\u0131tay\u2019\u0131n bu konuda verdi\u011fi karar da yeni de\u011fil. Bu konuda de\u011fi\u015fik yarg\u0131 kararlar\u0131 bulunuyor. Yarg\u0131tay 9. Hukuk Dairesi bu konuda yeni bir karar verdi ve cumartesi g\u00fcn\u00fcn\u00fcn y\u0131ll\u0131k izinden say\u0131laca\u011f\u0131na h\u00fckmetti.<\/p>\n<p>\u0130\u015fin hukuki boyutuna fazla girmeden durumu \u00f6zetleyeyim. Fabrikada \u00e7al\u0131\u015fan i\u015f\u00e7i, toplu i\u015f s\u00f6zle\u015fmesi kapsam\u0131nda, cumartesi g\u00fcnlerinin de dinlendirme g\u00fcn\u00fc olarak (akdi tatil) hafta tatili oldu\u011fu, y\u0131ll\u0131k izin s\u00fcresinden d\u00fc\u015f\u00fclemeyece\u011fi gerek\u00e7esiyle \u0130\u015f Mahkemesi\u2019ne m\u00fcracaat etti.\u0130\u015fveren ise toplu i\u015f s\u00f6zle\u015fmesinde cumartesi g\u00fcn\u00fcn\u00fcn hafta tatili oldu\u011funa dair d\u00fczenleme olmad\u0131\u011f\u0131n\u0131 savundu. \u0130\u015f Mahkemesi davac\u0131 i\u015f\u00e7iyi hakl\u0131 buldu, ancak karar temyize gitti ve konu Yarg\u0131tay 9. Hukuk Dairesine geldi.<\/p>\n<p><strong>YARGITAY NE KARAR VERD\u0130?&nbsp;<\/strong><\/p>\n<p>Yarg\u0131tay, bireysel ve toplu i\u015f s\u00f6zle\u015fmesinde cumartesi ve pazar g\u00fcnleri hafta tatili olarak belirlenmi\u015fse, y\u0131ll\u0131k izin s\u00fcrelerinden say\u0131lmaz, ancak s\u00f6zle\u015fmelerde cumartesi g\u00fcn\u00fc y\u0131ll\u0131k izin hesab\u0131nda i\u015f g\u00fcn\u00fc olarak say\u0131laca\u011f\u0131 veya izin s\u00fcresinden d\u00fc\u015f\u00fclmeyece\u011fi \u015feklinde kural mevcutsa sadece y\u0131ll\u0131k izne rastlayan pazar g\u00fcnleri y\u0131ll\u0131k izin s\u00fcresinden d\u00fc\u015f\u00fcl\u00fcr\u2019 karar\u0131n\u0131 verdi.<\/p>\n<p>Ayr\u0131ca Yarg\u0131tay karar\u0131nda, \u201cToplu i\u015f s\u00f6zle\u015fmesi d\u00fczenlemesinde taraflar\u0131n hafta tatili olarak kabul etti\u011fi pazar g\u00fcn\u00fc haricinde cumartesi g\u00fcn\u00fc de dinlendirilme g\u00fcn\u00fc olarak belirlenmi\u015f ve burada cumartesi g\u00fcn\u00fc hafta tatili olarak adland\u0131r\u0131lmad\u0131\u011f\u0131 gibi y\u0131ll\u0131k \u00fccretli izin hesab\u0131nda da izin s\u00fcresine eklenece\u011fine ili\u015fkin a\u00e7\u0131k bir d\u00fczenlemeye yer verilmemi\u015ftir\u201d diyor. Bu gerek\u00e7eyle de Yarg\u0131tay, i\u015f\u00e7inin ba\u015fvurusunu haks\u0131z buluyor. \u0130\u015fin hukuki boyutu \u00f6zetle b\u00f6yle.<\/p>\n<p><strong>BUNDAN SONRA NE OLACAK?&nbsp;<\/strong><\/p>\n<p>Peki, Yarg\u0131tay\u2019\u0131n bu karar\u0131 \u00f6zel sekt\u00f6r \u00e7al\u0131\u015fanlar\u0131n\u0131 nas\u0131l etkileyecek? Burada; \u00e7al\u0131\u015fan\u0131n hem i\u015fveren ile yapt\u0131\u011f\u0131 bireysel i\u015f s\u00f6zle\u015fmesinde hem de \u00e7al\u0131\u015fanlarla toplu olarak yap\u0131lan toplu i\u015f s\u00f6zle\u015fmesinde hafta tatili konusunda ne yazd\u0131\u011f\u0131 \u00f6nemli.<\/p>\n<p>Bireysel ya da toplu i\u015f s\u00f6zle\u015fmesinde cumartesi g\u00fcn\u00fc hafta tatili olarak kabul edilmi\u015fse \u00e7al\u0131\u015fan\u0131n y\u0131ll\u0131k izin s\u00fcresinden d\u00fc\u015f\u00fclmez. \u00d6rne\u011fin; \u00e7al\u0131\u015fan bir haftal\u0131k izin alm\u0131\u015fsa, y\u0131ll\u0131k izninden 5 g\u00fcn kullanm\u0131\u015f olur, cumartesi g\u00fcn\u00fc y\u0131ll\u0131k izinden say\u0131lmaz. Kimi s\u00f6zle\u015fmelerde cumartesi hafta tatili olarak kabul edilse bile i\u015f g\u00fcn\u00fc olarak ge\u00e7ebilir. Bu durumda y\u0131ll\u0131k izin s\u00fcresinden d\u00fc\u015f\u00fcl\u00fcr. Yani, y\u0131ll\u0131k izin cumartesi g\u00fcn\u00fcne denk gelirse y\u0131ll\u0131k izinden say\u0131l\u0131r.<\/p>\n<p>E\u011fer s\u00f6zle\u015fmede, cumartesi g\u00fcn\u00fc hafta tatili olarak kabul edilmemi\u015fse, i\u015f g\u00fcn\u00fc say\u0131laca\u011f\u0131ndan \u00e7al\u0131\u015fan\u0131n y\u0131ll\u0131k izninden d\u00fc\u015f\u00fcl\u00fcr. \u015e\u00f6yle anlatay\u0131m. \u00c7al\u0131\u015fan bir haftal\u0131k izin alm\u0131\u015fsa ve o i\u015fyerinde cumartesi hafta tatili olarak kabul edilmiyorsa; pazar g\u00fcn\u00fc hafta tatili oldu\u011fu i\u00e7in \u00e7al\u0131\u015fan y\u0131ll\u0131k izninden 6 g\u00fcn kullanm\u0131\u015f olur.\u00d6zetle, \u0130\u015f Kanunu\u2019na g\u00f6re hafta tatili, haftal\u0131k 45 saatlik \u00e7al\u0131\u015fmadan sonraki 24 saatlik bir g\u00fcnd\u00fcr. Buna g\u00f6re de cumartesi g\u00fcnleri asl\u0131nda i\u015f g\u00fcn\u00fcd\u00fcr.
