Y\u00fcksek Mahkeme; t\u00fcketiciyle akdedilen s\u00f6zle\u015fmelerde yer alan haks\u0131z \u015fartlar\u0131n kesin olarak h\u00fck\u00fcms\u00fcz oldu\u011funa h\u00fckmetti.<\/p>\n<p>Y\u0131llard\u0131r hayalini kurdu\u011fu evi, bir bankadan \u00e7ekti\u011fi konut kredisiyle alan t\u00fcketici, borcu \u00f6deyip tam rahat nefes almak isterken hayat\u0131n\u0131n \u015fokunu ya\u015fad\u0131. Banka, evi satan ki\u015finin borcu nedeniyle eve ipotek koydu. T\u00fcketici Mahkemesi\u2019nin yolunu tutan ma\u011fdur t\u00fcketici, bankan\u0131n kazan\u0131lm\u0131\u015f hak te\u015fkil eden ipotek fek beyan\u0131ndan tek tarafl\u0131 olarak d\u00f6nmesinin hukuken m\u00fcmk\u00fcn olmad\u0131\u011f\u0131n\u0131 dile getirdi. 284 bin TL bedelli ipotek nedeniyle bor\u00e7lu olmad\u0131\u011f\u0131n\u0131n tespitine ve ipote\u011fin fekkine karar verilmesini talep ve dava etti. Daval\u0131, davan\u0131n reddini talep etti. Davan\u0131n kabul\u00fcne h\u00fckmeden Mahkeme, davac\u0131n\u0131n daval\u0131ya 284 bin TL bor\u00e7lu olmad\u0131\u011f\u0131n\u0131n tespitine, dava konusu ta\u015f\u0131nmaz \u00fczerinde daval\u0131 lehine tesis edilen ipote\u011fin fekkine karar verdi. Daval\u0131 taraf\u0131ndan istinaf kanun yoluna ba\u015fvuruldu. B\u00f6lge Adliye Mahkemesi, daval\u0131n\u0131n istinaf ba\u015fvurusunun kabul\u00fcne, incelenen mahkeme karar\u0131n\u0131n usul ve yasaya uygun olmad\u0131\u011f\u0131ndan kald\u0131r\u0131lmas\u0131na, karar verdi. Davac\u0131 karar\u0131 temyiz edince devreye Yarg\u0131tay 3. Hukuk Dairesi girdi.<\/p>\n<p>Emsal nitelikteki kararda; davac\u0131n\u0131n dava d\u0131\u015f\u0131 bir ki\u015fiden ipotekli bir ta\u015f\u0131nmaz sat\u0131n ald\u0131\u011f\u0131na, ipote\u011fin konulu\u015f nedeninin \u00e7ekilen konut kredisi oldu\u011funa, ta\u015f\u0131nmaz\u0131 devrald\u0131ktan sonra ipotek borcunu \u00f6deyerek kapatt\u0131\u011f\u0131na dikkat \u00e7ekildi. Davac\u0131n\u0131n gerekli t\u00fcm har\u00e7 ve masraflar\u0131 yat\u0131rd\u0131ktan sonra daval\u0131dan ipote\u011fin fekkini talep etti\u011fi hat\u0131rlat\u0131ld\u0131. Daval\u0131n\u0131n \u00f6nce talebini kabul ederek tapu m\u00fcd\u00fcrl\u00fc\u011f\u00fcnden ipote\u011fin fekkini talep etti\u011fini ancak tapunun eksiklikler nedeniyle bankan\u0131n talebini yerine getirmemesi \u00fczerine, banka taraf\u0131ndan dava d\u0131\u015f\u0131 sat\u0131c\u0131n\u0131n bankaya olan farkl\u0131 bor\u00e7lar\u0131 oldu\u011fu gerek\u00e7esi ile ipote\u011fin fekkine y\u00f6nelik talebinin kabul edilmedi\u011fi dile getirildi.<\/p>\n<p>Kararda \u015f\u00f6yle denildi: \u201cDava tarihi itibariyle y\u00fcr\u00fcrl\u00fckte olan 6502 say\u0131l\u0131 T\u00fcketicinin Korunmas\u0131 Hakk\u0131nda Kanunun 5. maddesi ile s\u00f6zle\u015fmelerdeki haks\u0131z \u015fart d\u00fczenlenmi\u015f olup an\u0131lan kanun maddesinde \u2018Haks\u0131z \u015fart; t\u00fcketiciyle m\u00fczakere edilmeden s\u00f6zle\u015fmeye d\u00e2hil edilen ve taraflar\u0131n s\u00f6zle\u015fmeden do\u011fan hak ve y\u00fck\u00fcml\u00fcl\u00fcklerinde d\u00fcr\u00fcstl\u00fck kural\u0131na ayk\u0131r\u0131 d\u00fc\u015fecek bi\u00e7imde t\u00fcketici aleyhine dengesizli\u011fe neden olan s\u00f6zle\u015fme \u015fartlar\u0131d\u0131r. T\u00fcketiciyle akdedilen s\u00f6zle\u015fmelerde yer alan haks\u0131z \u015fartlar kesin olarak h\u00fck\u00fcms\u00fczd\u00fcr. S\u00f6zle\u015fmenin haks\u0131z \u015fartlar d\u0131\u015f\u0131ndaki h\u00fck\u00fcmleri ge\u00e7erlili\u011fini korur. Bu durumda s\u00f6zle\u015fmeyi d\u00fczenleyen, kesin olarak h\u00fck\u00fcms\u00fcz say\u0131lan \u015fartlar olmasayd\u0131 di\u011fer h\u00fck\u00fcmlerle s\u00f6zle\u015fmeyi yapmayacak oldu\u011funu ileri s\u00fcremez. Bir s\u00f6zle\u015fme \u015fart\u0131 \u00f6nceden haz\u0131rlanm\u0131\u015f ve standart s\u00f6zle\u015fmede yer almas\u0131 nedeniyle t\u00fcketici i\u00e7eri\u011fine etki edememi\u015fse, o s\u00f6zle\u015fme \u015fart\u0131n\u0131n t\u00fcketiciyle m\u00fczakere edilmedi\u011fi kabul edilir. S\u00f6zle\u015fmeyi d\u00fczenleyen, bir standart \u015fart\u0131n m\u00fcnferiden m\u00fczakere edildi\u011fini iddia ediyorsa bunu ispatla y\u00fck\u00fcml\u00fcd\u00fcr\u2019 denilmi\u015ftir. Somut uyu\u015fmazl\u0131kta; Tapu M\u00fcd\u00fcrl\u00fc\u011f\u00fcnce d\u00fczenlenmi\u015f olan ipotek senedinin \u2018s\u00f6zle\u015fme \u015fartlar\u0131\u2019 ba\u015fl\u0131kl\u0131 b\u00f6l\u00fcm\u00fcn 1. maddesi, yukar\u0131da a\u00e7\u0131klanan yasal d\u00fczenlemeler \u0131\u015f\u0131\u011f\u0131nda haks\u0131z \u015fart niteli\u011findedir. Hal b\u00f6yle olunca ilk derece mahkemesince davan\u0131n kabul\u00fcne dair verilen karar do\u011fru oldu\u011fundan b\u00f6lge adliye mahkemesince daval\u0131n\u0131n istinaf ba\u015fvurusunun esastan reddine karar verilmesi gerekirken b\u00f6lge adliye mahkemesince yerinde olmayan gerek\u00e7e ile daval\u0131n\u0131n istinaf ba\u015fvurusu kabul edilerek karar\u0131n kald\u0131r\u0131lmas\u0131na, davan\u0131n reddine karar verilmesi usul ve yasaya ayk\u0131r\u0131 olup, bozmay\u0131 gerektirir.
