Herkesin zaml\u0131 \u00fccret ald\u0131\u011f\u0131n\u0131 belirten i\u015f\u00e7i, \u2018emekli olaca\u011f\u0131n i\u00e7in sana zam yok\u2019 a\u00e7\u0131klamas\u0131yla sars\u0131ld\u0131.<\/p>\n

\u0130\u015f Mahkemesi\u2019nin yolunu tutan ma\u011fdur emekli, i\u015fverenin iste\u011fi hilaf\u0131na kendisini emekliye ay\u0131rd\u0131\u011f\u0131n\u0131 ileri s\u00fcrerek k\u0131dem tazminat\u0131 alaca\u011f\u0131n\u0131n tahsilini talep etti.<\/p>\n

Daval\u0131 patron, davan\u0131n reddini talep etti. Mahkeme; bakiye k\u0131dem tazminat\u0131 talebinin kabul\u00fcne karar verdi. Karar\u0131 taraflar istinafa g\u00f6t\u00fcrd\u00fc. B\u00f6lge Adliye Mahkemesi, davac\u0131n\u0131n istinaf talebinin esastan reddine, daval\u0131n\u0131n istinaf talebi kabul edilerek \u00f6denen miktar i\u00e7in karar verilmesine yer olmad\u0131\u011f\u0131na, bakiye k\u0131dem tazminat\u0131 talebinin reddine h\u00fckmetti.<\/p>\n

Karar\u0131 davac\u0131 temyiz edince devreye Yarg\u0131tay 9. Hukuk Dairesi girdi.<\/p>\n

Emsal nitelikte bir karara imza atan Y\u00fcksek Mahkeme; t\u00fcm i\u015f\u00e7ilere zam yap\u0131lmas\u0131na ra\u011fmen davac\u0131n\u0131n \u00fccretinin art\u0131r\u0131lmad\u0131\u011f\u0131na dikkat \u00e7ekti.<\/p>\n

Kararda, \u201cMahkeme, \u00fccrette y\u00fczde 3 art\u0131\u015f kabul edilerek bakiye k\u0131dem tazminat\u0131 h\u00fck\u00fcm alt\u0131na al\u0131nm\u0131\u015f, B\u00f6lge Adliye Mahkemesi\u2019nce i\u015fverenin \u00fccrette art\u0131\u015f uygulamama hususunda takdir yetkisi bulundu\u011fundan bahisle bakiye alacak talebi reddedilmi\u015ftir. Dosyadaki bilgi ve belgelerden; daval\u0131 i\u015fverenin i\u015f\u00e7ilerine sene ba\u015f\u0131nda y\u00fczde 3 oran\u0131nda zam yap\u0131ld\u0131\u011f\u0131 ancak davac\u0131 emekliye ayr\u0131laca\u011f\u0131 i\u00e7in davac\u0131n\u0131n \u00fccretine zam yans\u0131t\u0131lmad\u0131\u011f\u0131, zam yap\u0131lmamas\u0131 hususunda yetkili organca herhangi bir karar al\u0131nmad\u0131\u011f\u0131 gibi bu y\u00f6nde bir i\u015fyeri uygulamas\u0131n\u0131n da bulunmad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. \u015eu halde davac\u0131n\u0131n \u00fccretine y\u00fczde 3 zam ilave edilerek hesaplanacak k\u0131dem tazminat\u0131ndan \u00f6denenin mahs\u00fbbuyla bulunacak bakiye k\u0131dem tazminat\u0131 talebinin kabul\u00fc yerine reddi hatal\u0131d\u0131r. B\u00f6lge Adliye Mahkemesi karar\u0131n\u0131n bozulmas\u0131na oy birli\u011fi ile h\u00fckmedilmi\u015ftir\u201d ifadeleri yer ald\u0131.<\/p>\n
