Konut kiralar\u0131ndaki y\u00fcksek art\u0131\u015f nedeniyle eski kirac\u0131y\u0131 tahliye edip evi daha y\u00fcksek fiyatla kiraya vermek isteyenlerin say\u0131s\u0131 da bir hayli fazla. Bah\u00e7e\u015fehir \u00dcniversitesi (BAU) Hukuk Fak\u00fcltesi Dekan\u0131 Prof. Dr. Kadir Emre G\u00f6kyayla, Dekan Yard\u0131mc\u0131s\u0131 Do\u00e7. Dr. Zafer Kahraman ve Do\u00e7. Dr. Seda \u00d6ktem \u00c7evik son haftalarda g\u00fcndemden d\u00fc\u015fmeyen kira fiyatlar\u0131ndaki art\u0131\u015f ile ilgili \u2018Kira Hukuku\u2019 kapsam\u0131nda \u00f6zel a\u00e7\u0131klamalarda bulundu.<\/p>\n<h2><strong>\u201c5 YILDAN UZUN S\u00dcREN K\u0130RA S\u00d6ZLE\u015eMELER\u0130NE D\u0130KKAT\u201d<\/strong><\/h2>\n<p>S\u00f6zlerine kanun koyucunun konut ve \u00e7at\u0131l\u0131 i\u015f yeri kiralar\u0131nda kirac\u0131y\u0131 korumak y\u00f6n\u00fcnde bir tercihi oldu\u011funu hat\u0131rlatarak ba\u015flayan Do\u00e7. Dr. Zafer Kahraman, \u201cKural olarak s\u00f6zle\u015fmelerde s\u00f6zle\u015fme serbesti esast\u0131r. Bunun anlam\u0131, kanun taraf\u0131ndan s\u0131n\u0131rlama getirilmemi\u015f ise, taraflar\u0131n mutabakatla her t\u00fcrl\u00fc s\u00f6zle\u015fmeyi, arzu ettikleri i\u00e7erikte yapabilecekleridir. Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda ise, kanunun emredici kurallar\u0131 ile getirdi\u011fi s\u0131n\u0131rlamalardan bir tanesi de kira art\u0131\u015f\u0131nda 12 ayl\u0131k T\u00dcFE ortalamas\u0131n\u0131n s\u0131n\u0131r olarak getirilmesidir. Burada kanun koyucu, s\u00f6zle\u015fme serbestisini kirac\u0131y\u0131 koruma amac\u0131yla s\u0131n\u0131rlam\u0131\u015ft\u0131r. Halbuki, kanuni s\u0131n\u0131rlamalar\u0131n bulunmad\u0131\u011f\u0131 hallerde, b\u00f6yle bir s\u0131n\u0131rlama s\u00f6z konusu olmayacakt\u0131r. Kanuna g\u00f6re, ilk be\u015f y\u0131l i\u00e7in kira bedellerinin art\u0131\u015f\u0131nda 12 ayl\u0131k T\u00dcFE ortalamas\u0131 \u00fcst s\u0131n\u0131r te\u015fkil edecek; daha sonra ise -be\u015f y\u0131ldan uzun s\u00fcren kira s\u00f6zle\u015fmelerinde ise- s\u00f6zle\u015fmenin taraflar\u0131 hakkaniyet, de\u011fi\u015fen rayi\u00e7ler ve T\u00dcFE oranlar\u0131na g\u00f6re bir belirlemenin yap\u0131lmas\u0131n\u0131 talep edebileceklerdir. Bu \u201cbelirleme\u201d asl\u0131nda bir t\u00fcr uyarlamad\u0131r. Buna g\u00f6re, kiraya veren veya kirac\u0131, be\u015f y\u0131ldan uzun s\u00fcren kira s\u00f6zle\u015fmelerinde kira bedelini yeniden belirlemek (uyarlamak) i\u00e7in dava a\u00e7abilecektir. Di\u011fer bir deyi\u015fle, be\u015f y\u0131ldan uzun s\u00fcren konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda, T\u00dcFE s\u0131n\u0131r\u0131 \u00fcst s\u0131n\u0131r olmayacak, rayi\u00e7 bedel ve hakkaniyet gerektirdi\u011fi takdirde bu s\u0131n\u0131r\u0131n \u00fczerinde bir kira bedeli belirlenebilecektir. \u00c7o\u011fu kirac\u0131, kira ili\u015fkisi bitti\u011finde \u00f6rne\u011fin anahtar\u0131n\u0131n teslimini yapm\u0131yor. Teslim hukuki bir i\u015flem oldu\u011fu i\u00e7in, bir\u00e7ok hukuki i\u015flem gibi yaz\u0131l\u0131 delille ispat edilmelidir. Kira s\u00f6zle\u015fmesinin ba\u015f\u0131nda ve sonunda, kiralanan\u0131n teslim al\u0131nd\u0131\u011f\u0131n\u0131 ve teslim edildi\u011fini belgelendirmek, olas\u0131 ihtilaflar\u0131 \u00f6nlemek a\u00e7\u0131s\u0131ndan \u00f6nemlidir\u201d dedi.<\/p>\n<p>\u00d6te yandan, be\u015f y\u0131ll\u0131k kira s\u00fcresi dolduktan sonra 344. maddenin 3. f\u0131kras\u0131na g\u00f6re belirlenen kriterlerin uyguland\u0131\u011f\u0131n\u0131 ve hakim taraf\u0131ndan yeniden bir kira bedeli belirlendi\u011fini ifade eden Prof. Dr. Kadir Emre G\u00f6kyayla ise, konuyla ilgili \u015funlar\u0131 s\u00f6yledi:<\/p>\n<p>\u201c\u00d6rne\u011fin; be\u015f y\u0131l dolduktan sonra kiray\u0131 veren, kira bedelinin yeniden belirlenmesi amac\u0131yla dava a\u00e7t\u0131. Aradan da bir bu\u00e7uk sene daha ge\u00e7ti ama dava sonu\u00e7lanmadan kirac\u0131 tahliye etti. \u0130\u015fte burada rayi\u015f dikkate al\u0131n\u0131yor. Buna eski kirac\u0131 indirimi de denilebilir. Enflasyon oran\u0131 gibi veriler dikkate al\u0131narak kira bedelinde \u00e7o\u011fu zaman yeni kira bedelini belirleme s\u00f6z konusu oluyor. Dolay\u0131s\u0131yla o bir bu\u00e7uk y\u0131ll\u0131k d\u00f6nemi mahkemenin belirleyece\u011fi mebla\u011f \u00fczerinden kirac\u0131n\u0131n \u00f6demesi gerekiyor\u201d dedi.<\/p>\n<h2><strong>K\u0130RACI NELERDEN SORUMLU?<\/strong><\/h2>\n<p>Kira bedellerinin \u00f6denmesi ile ilgili konu\u015fan Prof. Dr. Kadir Emre G\u00f6kyayla, \u201cKonut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda kirac\u0131, \u00f6zellikle kira bedeli ve s\u00f6zle\u015fmenin sona erme sebepleri bak\u0131m\u0131ndan kay\u0131r\u0131lm\u0131\u015ft\u0131r. S\u00f6zle\u015fme taraflar\u0131 aras\u0131ndaki menfaat dengesi, bilin\u00e7li olarak kirac\u0131 lehine tesis edilmi\u015ftir. Sona erme sebepleri bak\u0131m\u0131ndan korunmas\u0131, kirac\u0131n\u0131n s\u00f6zle\u015fmeden do\u011fan bor\u00e7lar\u0131n\u0131 ifa etmesine ba\u011fl\u0131d\u0131r. Buna kar\u015f\u0131l\u0131k kirac\u0131, kira bedelinin sembolik bir k\u0131sm\u0131n\u0131 \u00f6demese dahi, kiraya veren bedelin eksik \u00f6dendi\u011fi iddias\u0131yla kira s\u00f6zle\u015fmesini sona erdirebilir. Kira s\u00f6zle\u015fmesinin en basit sona erdirme \u015fekli kira bedelini \u00f6dememeye dayan\u0131r. Bir lira dahi eksik olsa tablo ayn\u0131d\u0131r \u00e7\u00fcnk\u00fc kira bedeli tam olarak ifa edilmemi\u015ftir. Uygulamada da s\u00f6zle\u015fmenin sona erece\u011fine karar veriliyor. Kira s\u00f6zle\u015fmesinin sona ermesinin sonucu olarak kirac\u0131 kiralanan\u0131n tahliye etmeli ve kiraya verene geri vermelidir. Bir noktay\u0131 daha burada ilave etmek laz\u0131m. Kirac\u0131, kararla\u015ft\u0131r\u0131lm\u0131\u015fsa, kira bedeli haricinde giderleri de \u00f6demek zorunda. Onlar\u0131 \u00f6demedi\u011fi takdirde yine temerr\u00fcde d\u00fc\u015febilir. Nedir s\u00f6z\u00fc edilen yan giderler, mesela tipik olarak sitelerde, apartmanlarda \u00f6denmesi gereken aidatlar bu kapsamda say\u0131labilir. Bunlar\u0131 da \u00f6demek gerekir\u201d \u00f6nerisinde bulundu.<\/p>\n<p>Kirac\u0131lar\u0131n olas\u0131 erken tahliyesi ile ilgili konu\u015fan Do\u00e7. Dr. Seda \u00d6ktem \u00c7evik ise, T\u00fcrk Bor\u00e7lar Kanunu\u2019nda bu konuda bir d\u00fczenlemenin bulundu\u011funu belirtti. \u00d6ktem \u00c7evik, \u201cT\u00fcrk Bor\u00e7lar Kanunu m. 325 gere\u011fince, kirac\u0131n\u0131n s\u00f6zle\u015fme s\u00fcresine veya fesih d\u00f6nemine uymaks\u0131z\u0131n kiralanan\u0131 geri vermesi halinde kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131, kiralanan\u0131n benzer ko\u015fullarla kiraya verilebilece\u011fi makul bir s\u00fcre i\u00e7in devam eder. Burada somut uyu\u015fmazl\u0131k bak\u0131m\u0131ndan kiralanan\u0131n ne kadar s\u00fcrede yeniden kiraya verilece\u011fi hususu mahkemece tespit edilir. Ancak kirac\u0131n\u0131n bu s\u00fcrenin ge\u00e7mesinden \u00f6nce kiraya verenden kabul etmesi beklenebilecek, \u00f6deme g\u00fcc\u00fcne sahip ve kira ili\u015fkisini devralmaya haz\u0131r yeni bir kirac\u0131 bulmas\u0131 h\u00e2linde, kirac\u0131n\u0131n kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131 sona erer\u201d dedi.<\/p>\n<h2><strong>\u201cPANDEM\u0130 D\u00d6NEM\u0130NDE DEVLET TARAFINDAN KAPATILAN YERLER \u0130\u00c7\u0130N K\u0130RA TALEP ED\u0130LEMEZ\u201d<\/strong><\/h2>\n<p>Son olarak pandemi ile ilgili kira hukuku \u00f6zelinde de hukuki \u00e7\u00f6z\u00fcm \u00f6nerileri payla\u015fan Do\u00e7. Dr. Zafer Kahraman, \u201cPandemi baz\u0131 kira s\u00f6zle\u015fmelerini hasta etti. Baz\u0131 kira s\u00f6zle\u015fmelerine ise bula\u015fmad\u0131. S\u00f6zle\u015fmenin ak\u0131betini belirlerken, s\u00f6zle\u015fmenin taraflar\u0131n\u0131n ne kadar ve ne y\u00f6nde etkilendi\u011fini anlamam\u0131z laz\u0131m. Mesela, salg\u0131n\u0131n g\u00f6lgesi alt\u0131nda ya\u015farken baz\u0131 marketlerin \u00e7ok daha fazla k\u00e2rlar etti\u011fini g\u00f6rd\u00fck. Dolay\u0131s\u0131yla o marketlerin salg\u0131ndan ve yasaklardan k\u00f6t\u00fc etkilendi\u011fini ileri s\u00fcrmesi m\u00fcmk\u00fcn de\u011fildir. Buna kar\u015f\u0131n, baz\u0131 i\u015f yerlerinin, al\u0131\u015fveri\u015f merkezlerindeki baz\u0131 ma\u011fazalar\u0131n ve restoranlar\u0131n da kapand\u0131\u011f\u0131n\u0131 g\u00f6rd\u00fck. Kapanma karar\u0131n\u0131 devlet veriyor. Dolay\u0131s\u0131yla bunda ne kiraya verenin ne de kirac\u0131n\u0131n kusuru var. Her iki taraf i\u00e7in de ka\u00e7\u0131n\u0131lmaz bir nedenle ba\u015fa gelen bir olay s\u00f6z konusudur. \u0130ki taraf\u0131n da bunda kusuru olmasa da art\u0131k o s\u00f6zle\u015fmenin ifa edilmesi devlet otoritesinin getirdi\u011fi yasak sebebiyle imk\u00e2ns\u0131z hale gelmi\u015ftir. Zira, kiralanan\u0131 kirac\u0131n\u0131n kullan\u0131m\u0131na b\u0131rakmak kiraya verenin temel borcudur. Kiraya veren, kiralanan\u0131 kullan\u0131ma b\u0131rakmakla y\u00fck\u00fcml\u00fc olmas\u0131na ra\u011fmen, devlet yasaklamalar\u0131 nedeniyle art\u0131k bu borcunu yerine getirmesi m\u00fcmk\u00fcn olmuyor. Kirac\u0131 ise, kiralanan\u0131 kullanmak, i\u015fletmek, i\u015f yerini \u00e7al\u0131\u015ft\u0131rmak istiyor ama yapam\u0131yor. Buna hukukta imk\u00e2ns\u0131zl\u0131k diyoruz. Bu ihtimalde, m\u00fccbir sebebin yaratt\u0131\u011f\u0131 bir imk\u00e2ns\u0131zl\u0131kla kar\u015f\u0131la\u015f\u0131yoruz. Tabi burada \u00f6\u011fretide baz\u0131 tart\u0131\u015fmalar var olsa da \u015fu kesindir: yani o d\u00f6nem i\u00e7in o s\u00f6zle\u015fmeden kirac\u0131 faydalanamad\u0131 ve bunda hi\u00e7 kimsenin kusuru yok. Bu d\u00f6nemde bir imk\u00e2ns\u0131zl\u0131k ya\u015fand\u0131. Dolay\u0131s\u0131yla, s\u0131rf o d\u00f6neme has olarak kar\u015f\u0131l\u0131kl\u0131 bor\u00e7lar sona ermi\u015ftir. O d\u00f6nemde devlet otoritesinin yasa\u011f\u0131 ile kapanan yerler i\u00e7in kirac\u0131 \u2013yasak d\u00f6nemine ili\u015fkin- kiray\u0131 \u00f6demekten kurtulur. Kiraya veren, kira bedelinin \u00f6denmesini talep edemez. Devlet otoritesiyle kapanma imk\u00e2ns\u0131zl\u0131\u011fa yol a\u00e7t\u0131\u011f\u0131 i\u00e7in bu sonu\u00e7 kendili\u011finden meydana gelir. Yasaklar bitti\u011finde ise, s\u00f6zle\u015fme yeniden uygulamaya d\u00f6ner.
