Bu durum dava sebebi olabilir.<\/p>\n<p>TED \u00dcniversitesi \u0130ktisadi ve \u0130dari Bilimler Fak\u00fcltesi \u00d6\u011fretim \u00dcyesi Prof. Dr. \u015eebnem Akipek, konunun hukuki boyutuna ili\u015fkin de\u011ferlendirmede bulundu.<\/p>\n<p>Her \u015fehirde il h\u0131fz\u0131ss\u0131hha kurullar\u0131n\u0131n halk sa\u011fl\u0131\u011f\u0131n\u0131n korunmas\u0131 amac\u0131yla d\u0131\u015f ortam s\u0131cakl\u0131\u011f\u0131 belli bir derecenin alt\u0131na d\u00fc\u015f\u00fcnce \u0131s\u0131tma sistemlerinin \u00e7al\u0131\u015ft\u0131r\u0131lmas\u0131 karar\u0131n\u0131 ald\u0131\u011f\u0131n\u0131 hat\u0131rlatan Akipek, bu s\u0131cakl\u0131\u011f\u0131n genellikle&nbsp;15 derece olarak&nbsp;belirlendi\u011fini s\u00f6yledi.<\/p>\n<p>Akipek, Kat M\u00fclkiyeti Kanunu&#8217;nun da bu konuya ili\u015fkin hususlar\u0131 i\u00e7erdi\u011fine dikkati \u00e7ekerek, kanunun 18&#8217;inci maddesinde &#8220;Kat irtifak\u0131 sahipleri bu hakka konu olan ortak arsa \u00fczerinde, ileride kat m\u00fclkiyetine \u00e7evrilmek \u00fczere yap\u0131lacak yap\u0131n\u0131n s\u00f6zle\u015fmeye ve plana g\u00f6re tamamlanmas\u0131 i\u00e7in kendilerine d\u00fc\u015fen bor\u00e7lar\u0131 vaktinde yerine getirmek ve yap\u0131 i\u015fini, do\u011fruluk kaideleri uyar\u0131nca kolayla\u015ft\u0131rmakla, kar\u015f\u0131l\u0131kl\u0131 olarak y\u00fck\u00fcml\u00fcd\u00fcrler&#8221; h\u00fckm\u00fcn\u00fcn yer ald\u0131\u011f\u0131n\u0131 belirtti.<\/p>\n<p>Bu madde gere\u011fi kom\u015fular\u0131n birbirini rahats\u0131z etmeden ve do\u011fruluk kaidelerine uyarak konutlar\u0131n\u0131 kullanmas\u0131 gerekti\u011fine i\u015faret eden Akipek, bu do\u011fruluk kaideleri gere\u011fince kom\u015fular\u0131n birbirinin ho\u015funa gitmeyecek tutumlardan ka\u00e7\u0131nmas\u0131 gerekti\u011fini dile getirdi.<\/p>\n<h2>&#8220;DO\u011eRULUK VE D\u00dcR\u00dcSTL\u00dcK KURALLARI&#8221; UYARISI<\/h2>\n<p>Akipek, bir kat malikinin&nbsp;kaloriferi yakmayarak yan, alt ve \u00fcst kom\u015fusu sayesinde \u0131s\u0131nmas\u0131n\u0131n do\u011fruluk ve d\u00fcr\u00fcstl\u00fck kurallar\u0131na ayk\u0131r\u0131 oldu\u011funu ifade ederek, \u015f\u00f6yle konu\u015ftu:<\/p>\n<p>&#8220;Bu durumda&nbsp;kaloriferi yakmayan ki\u015fi, kom\u015fusunun daha fazla yakmas\u0131na sebebiyet veriyor. Bu ki\u015fi, Kat M\u00fclkiyeti Kanunu a\u00e7\u0131s\u0131ndan kom\u015fuluk ili\u015fkileri bak\u0131m\u0131ndan kom\u015fular\u0131na zarar veriyor duruma d\u00fc\u015f\u00fcyor. Yine kanunun 33&#8217;\u00fcnc\u00fc maddesi gere\u011fi&nbsp;kaloriferi yakan kom\u015fu, ana ta\u015f\u0131nmaz\u0131n bulundu\u011fu yerdeki sulh hukuk mahkemesine ba\u015fvurarak hakimin m\u00fcdahalesini isteyebiliyor.<\/p>\n<p>Burada kat maliki, &#8216;Benim kom\u015fum&nbsp;kaloriferini hi\u00e7 yakm\u0131yor, bundan dolay\u0131 daha fazla yakmak durumunda kal\u0131yorum. Benim sayemde o \u0131s\u0131n\u0131yor, buna m\u00fcdahale edin.&#8217; diyebiliyor. Hakim de kom\u015funun konutunu mevsim ko\u015fullar\u0131na uygun kullanmad\u0131\u011f\u0131na karar verip, yapt\u0131\u011f\u0131n\u0131 sonland\u0131rmas\u0131n\u0131 isteyebilir.<\/p>\n<p>Hakim, talep halinde, kom\u015fu maddi zarara u\u011fram\u0131\u015fsa bu maddi zarar\u0131n tazminine karar verebilir. Normalde ayl\u0131k 500 liral\u0131k \u0131s\u0131tma gideri olan bir ki\u015fi, 700 lira yakmak zorunda kald\u0131ysa bu zarar\u0131n tazminini isteyebilir.&#8221;<\/p>\n<p>Bu durumlarda belediyeye de insan sa\u011fl\u0131\u011f\u0131n\u0131 olumsuz etkileyen i\u015flem gerek\u00e7esiyle ba\u015fvurulmas\u0131n\u0131n \u00e7\u00f6z\u00fcm olabilece\u011fini vurgulayan Akipek, &#8220;Bunlar\u0131n d\u0131\u015f\u0131nda, T\u00fcrk Medeni Kanunu&#8217;nda da kom\u015fuluk hukuku ayr\u0131ca d\u00fczenlenmi\u015f durumda. Burada da kom\u015fuluk hukukuna ayk\u0131r\u0131, kom\u015fular\u0131n katlanma s\u0131n\u0131rlar\u0131n\u0131 a\u015fan eylem s\u00f6z konusu. Kanun gere\u011fince yine kom\u015funun hakk\u0131 do\u011fuyor&#8221; dedi.<\/p>\n<p>Akipek, evin bo\u015f olmas\u0131, aylarca beklenmesine ra\u011fmen sat\u0131lmamas\u0131 ya da kiraya verilmemesi durumunda da kom\u015fular\u0131n birbirlerine fedakarl\u0131k g\u00f6stermesi gerekebilece\u011fini belirterek, &#8220;Burada s\u0131n\u0131r\u0131m\u0131z do\u011fruluk kurallar\u0131. O noktada bo\u015f olan dairenin \u0131s\u0131t\u0131lmas\u0131n\u0131 istemek \u00e7ok m\u00fcmk\u00fcn olmayabilir ancak kom\u015fusuna zarar verme kast\u0131yla dairenin bo\u015f tutulmas\u0131 halinde ku\u015fkusuz yine hakimin m\u00fcdahalesi istenebilir&#8221; diye konu\u015ftu.<\/p>\n<p>Kat maliklerinin ellerinde bir olanak daha bulundu\u011funu aktaran Akipek, \u0131s\u0131tma sisteminin ferdi sistemden merkezi sisteme d\u00f6n\u00fc\u015ft\u00fcr\u00fclmesinin talep edilebilece\u011fini anlatt\u0131. Akipek, &#8220;Bu talep tek bir kat malikinden gelebilir ancak bunun i\u00e7in kat maliklerinin say\u0131 ve arsa pay\u0131 \u00e7o\u011funlu\u011fuyla karar almalar\u0131 gerekir&#8221; de\u011ferlendirmesinde bulundu.<\/p>\n<h2>&#8220;CEZA\u0130 \u0130\u015eLEM UYGULANIYOR&#8221;<\/h2>\n<p>Tesis Y\u00f6neticileri Federasyonu Ba\u015fkan\u0131 Yahya Sa\u011f\u0131r da \u0131s\u0131 pay \u00f6l\u00e7er kullanan konutlara ili\u015fkin, &#8220;Merkezi \u0131s\u0131tma sistemli, \u0131s\u0131 pay \u00f6l\u00e7erli konutlarda, k\u0131\u015f sezonunda s\u0131cakl\u0131\u011f\u0131n 15 derecenin alt\u0131na d\u00fc\u015fmesi halinde&nbsp;kaloriferlerin yak\u0131lmas\u0131 zorunlu. Ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmler bo\u015f dahi olsa bu zorunluluk var. S\u0131cakl\u0131\u011f\u0131n 15 derecenin \u00fczerine \u00e7\u0131kmas\u0131 halinde de \u0131s\u0131tma sistemlerinin kapat\u0131lmas\u0131 gerekiyor. Bu husus, \u00c7evre ve \u015eehircilik Bakanl\u0131\u011f\u0131&#8217;n\u0131n \u0131s\u0131 pay \u00f6l\u00e7erlere ili\u015fkin mevzuat\u0131yla d\u00fczenleniyor&#8221; dedi.<\/p>\n<p>Uygulamaya uyulmamas\u0131 halinde cezai i\u015flemin g\u00fcndeme gelebilece\u011fine dikkati \u00e7eken Sa\u011f\u0131r, &#8220;Vanas\u0131n\u0131 kapatanlara, faturalardaki ortalama t\u00fcketim bedeline g\u00f6re cezai i\u015flem uygulan\u0131yor.
