Kararda, &#8220;Kirac\u0131 \u00f6lse bile kiradan miras\u00e7\u0131lar\u0131 sorumludur&#8221; denildi.<\/p>\n<p>Kirac\u0131 ile m\u00fclk sahibi aras\u0131ndaki y\u0131llar s\u00fcren tart\u0131\u015fma yarg\u0131ya intikal etti. Asliye Hukuk Mahkemesi, el atman\u0131n \u00f6nlenmesi davas\u0131n\u0131n a\u00e7\u0131lmam\u0131\u015f say\u0131lmas\u0131na, davac\u0131lar\u0131n a\u00e7t\u0131\u011f\u0131 ecri misil davas\u0131n\u0131n reddine h\u00fckmetti. Karar temyiz edilince devreye giren Yarg\u0131tay 8. Hukuk Dairesi, mahkeme karar\u0131n\u0131 bozdu. <br \/>Kararda; kira s\u00fcresinin 2 y\u0131l oldu\u011fu, davac\u0131lar\u0131n el atman\u0131n \u00f6nlenmesine y\u00f6nelik taleplerinden vazge\u00e7tiklerini beyan etti\u011fine dikkat \u00e7ekildi.<\/p>\n<p>Kararda; \u201cDaval\u0131n\u0131n elbirli\u011fi maliklerinden yaln\u0131zca biri ile kira s\u00f6zle\u015fmesi yapmakla k\u00f6t\u00fc niyetli oldu\u011funun ve her bir orta\u011f\u0131n veraset ilam\u0131ndaki pay\u0131 oran\u0131nda ecrimisil talep edebilece\u011finin kabul\u00fc gerekir. Her ne kadar dava d\u0131\u015f\u0131 m\u00fcfidenin yapt\u0131\u011f\u0131 kira s\u00f6zle\u015fmesi ge\u00e7ersiz ise de bu husus dava konusu yap\u0131lmaktan vazge\u00e7ilmi\u015ftir. Hal b\u00f6yle olunca, ecrimisil istemi y\u00f6n\u00fcnden yukar\u0131da yaz\u0131l\u0131 ilkelere g\u00f6re inceleme yap\u0131larak sonucuna g\u00f6re bir karar verilmesi gerekirken, yaz\u0131l\u0131 gerek\u00e7e ile sonuca gidilmesi do\u011fru de\u011fildir\u201d ifadeleri yer ald\u0131.<\/p>\n<p><strong>EMSAL KARAR<\/strong><\/p>\n<p>Daval\u0131 karar\u0131n d\u00fczeltilmesi talebiyle Yarg\u0131tay\u2019a ba\u015fvurdu. Yarg\u0131tay 8. Hukuk Dairesi emsal nitelikte bir karara imza att\u0131.<\/p>\n<p>Kararda; \u201c\u00c7eki\u015fme konusu 16 parsel say\u0131l\u0131 ta\u015f\u0131nmaz\u0131n davac\u0131lar\u0131n murisi ad\u0131na kay\u0131tl\u0131 oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Kay\u0131t maliki taraf\u0131ndan 01\/05\/2005 ba\u015flang\u0131\u00e7 tarihli ve \u00fc\u00e7 y\u0131l s\u00fcreli yaz\u0131l\u0131 kira s\u00f6zle\u015fmesi ile daval\u0131 \u015firkete kiraya verildi\u011fi hususunda taraflar aras\u0131nda uyu\u015fmazl\u0131k bulunmamaktad\u0131r. Ge\u00e7erli olan bir kira s\u00f6zle\u015fmesi ya taraflar\u0131n birbirine uygun fesih bildirimi ile ya mahkeme karar\u0131 ile ya da kiralanan\u0131n yok olmas\u0131 ile sona erer. Kay\u0131t malikinin 2007 tarihinde vefat etmesi ile t\u00fcm miras\u00e7\u0131lar\u0131 kiraya veren s\u0131fat\u0131n\u0131 kendili\u011finden kazan\u0131rlar. Miras\u00e7\u0131lardan biri taraf\u0131ndan murisin \u00f6l\u00fcm\u00fcnden sonra yap\u0131lan kira s\u00f6zle\u015fmesi, kay\u0131t maliki ile yap\u0131lan 01\/05\/2005 ba\u015flang\u0131\u00e7 tarihli kira s\u00f6zle\u015fmesini sona erdirmez.<br \/>Hal b\u00f6yle olunca daval\u0131n\u0131n dava konusu ta\u015f\u0131nmaz\u0131 01\/05\/2005 ba\u015flang\u0131\u00e7 tarihli kira s\u00f6zle\u015fmesine dayanarak kirac\u0131 s\u0131fat\u0131yla kulland\u0131\u011f\u0131 bu seferki incelemeden anla\u015f\u0131lmakla daval\u0131 vekilinin karar d\u00fczeltme isteminin kabul\u00fc ile 1.
