Ancak ba\u015fta b\u00fcy\u00fck \u015fehirler olmak \u00fczere T\u00fcrkiye genelinde kiralar\u0131n normal art\u0131\u015f band\u0131n\u0131n \u00e7ok \u00fcst\u00fcne \u00e7\u0131karak astronomik rakamlara ula\u015fmas\u0131 tepkilere neden oldu. Ev sahiplerince talep edilen ve kimi semtlerde y\u00fczde 100\u2019lere yakla\u015fan art\u0131\u015f talepleri, kirac\u0131lar\u0131n b\u00fcy\u00fck ma\u011fduriyet ya\u015famalar\u0131na yol a\u00e7t\u0131. Dr. Umut Yeniocak, kira bedelinin y\u00fcksek oranda artt\u0131r\u0131lmas\u0131 i\u00e7in ev sahipleri taraf\u0131ndan bask\u0131ya maruz kalan kirac\u0131lar\u0131n yasal haklar\u0131 ve b\u00f6yle bir durumda atabilecekleri hukuki ad\u0131mlar\u0131 anlatt\u0131.<\/p>\n<p>T\u00fcrk hukuk sisteminin, kira s\u00f6zle\u015fmesi yap\u0131l\u0131rken bir ev ya da i\u015f yerinin ne kadara kiraland\u0131\u011f\u0131na kural olarak m\u00fcdahale etmedi\u011fini belirten Do\u00e7. Dr. Yeniocak, &#8220;Ancak Kanun, kira s\u00f6zle\u015fmesi bir kez yap\u0131ld\u0131ktan sonra kira bedelini a\u015f\u0131r\u0131 art\u0131rmak ve eski kirac\u0131y\u0131 evden ya da i\u015f yerinden \u00e7\u0131kar\u0131p yerine yeni bir kirac\u0131ya daha y\u00fcksek bedelle kiralamak isteyen ev sahiplerine kar\u015f\u0131 \u00f6nemli s\u0131n\u0131rlar koyar. Bu s\u0131n\u0131rlardan en \u00e7ok bilineni de kira art\u0131\u015f\u0131yla ilgili T\u00dcFE s\u0131n\u0131rlamas\u0131d\u0131r&#8221; dedi.<\/p>\n<p><strong>&#8220;K\u0130RA ARTI\u015eINDA TAVAN, 12 AYIN T\u00dcFE ORTALAMASIDIR&#8221;<\/strong><\/p>\n<p>\u0130lgili Kanun\u2019un, kira s\u00fcresi sona erdikten sonra yeni d\u00f6nem kiras\u0131 belirlenirken uygulanacak art\u0131\u015fta on iki ayl\u0131k T\u00dcFE ortalamas\u0131n\u0131 \u00fcst s\u0131n\u0131r olarak belirledi\u011fini hat\u0131rlatan Do\u00e7. Dr. Yeniocak, \u201cBurada dikkat edilmesi gereken nokta, bu oran\u0131n \u00fcst s\u0131n\u0131r yani tavan miktar oldu\u011fudur. Yap\u0131lacak art\u0131\u015f bu oran\u0131n alt\u0131nda olabilir ama \u00fcst\u00fcnde olamaz. Ev sahibi, kirac\u0131y\u0131 buna zorlayamaz. \u00d6rne\u011fin, s\u00f6zle\u015fmede y\u00fczde 20 art\u0131\u015f yap\u0131laca\u011f\u0131 yaz\u0131yor ancak T\u00dcFE y\u00fczde 15 olmu\u015fsa, s\u00f6zle\u015fmedeki oran de\u011fil T\u00dcFE oran\u0131 uygulan\u0131r. Kirac\u0131, en fazla T\u00dcFE oran\u0131nda art\u0131\u015f yaparak, kirac\u0131 oldu\u011fu evi ya da i\u015fyerini kullanmaya devam edebilir\u201d a\u00e7\u0131klamas\u0131n\u0131 yapt\u0131.<\/p>\n<p><strong>EV SAH\u0130B\u0130 K\u0130RACIYA TAZM\u0130NAT \u00d6DEMEK ZORUNDA KALAB\u0130L\u0130R<\/strong><\/p>\n<p>Mevcut kirac\u0131y\u0131 \u00e7\u0131kar\u0131p yerine y\u00fcksek bedelle yeni kirac\u0131 almak isteyen m\u00fclk sahiplerinin, evde kendisinin ya da \u00e7ocu\u011funun oturaca\u011f\u0131n\u0131, eve ya da i\u015fyerine ihtiyac\u0131 oldu\u011funu s\u00f6yleyerek kirac\u0131y\u0131 \u00e7\u0131karmak istemelerinin s\u0131k\u00e7a ba\u015fvurulan bir y\u00f6ntem oldu\u011funun bilindi\u011fini belirten Do\u00e7. Dr. Umut Yeniocak, &#8220;Kanun, bu durumu k\u00f6t\u00fcye kullananlar i\u00e7in \u00f6nemli bir kural koymu\u015ftur. \u00d6rne\u011fin, \u00e7ocu\u011funun ihtiyac\u0131 oldu\u011funu s\u00f6yleyip kirac\u0131y\u0131 \u00e7\u0131karan k\u00f6t\u00fc niyetli ev sahibi, bu yeri ba\u015fkas\u0131na kiralarsa, kanuna g\u00f6re, eski kirac\u0131 dava a\u00e7arak 12 ayl\u0131k kira bedelinden az olmamak \u00fczere ev sahibinden tazminat hakk\u0131 kazanabilir&#8221; diye konu\u015ftu. &nbsp;&nbsp;<\/p>\n<p><strong>EV SAH\u0130B\u0130 K\u0130RA BEDEL\u0130N\u0130N ARTIRILMASI \u0130\u00c7\u0130N DAVA A\u00c7AB\u0130L\u0130R<\/strong><\/p>\n<p>Kira bedellerinin a\u015f\u0131r\u0131 artmas\u0131yla istedikleri kira gelirini elde edemeyen ev sahiplerinin de yarar\u0131na olan baz\u0131 kurallar oldu\u011funu ifade den Do\u00e7. Dr. Umut Yeniocak, \u015funlar\u0131 s\u00f6yledi:<\/p>\n<p>&#8220;\u00d6rne\u011fin, kira ba\u015flang\u0131c\u0131ndan itibaren be\u015f y\u0131l ge\u00e7mi\u015f ve kira bedeli, emsalleri kar\u015f\u0131s\u0131nda \u00e7ok d\u00fc\u015f\u00fck kalm\u0131\u015fsa ev ya da i\u015fyeri sahibi, kira bedelinin artt\u0131r\u0131lmas\u0131 i\u00e7in dava a\u00e7abilir. Ayr\u0131ca, 2012\u2019de getirilen bir kurala g\u00f6re, kira s\u00fcresi bittikten sonra ayn\u0131 evde veya i\u015fyerinde kirac\u0131 olarak kalan kirac\u0131y\u0131 ev sahibi, on y\u0131l sonra hakl\u0131 bir sebep bildirmeden \u00e7\u0131karabilir. \u00d6rne\u011fin, bir y\u0131l s\u00fcreli bir konut kiras\u0131nda ev sahibi, bir y\u0131l\u0131n dolmas\u0131n\u0131n ard\u0131ndan on y\u0131l bekleyecek ve sonras\u0131nda kirac\u0131y\u0131 \u00e7\u0131karabilecek.
