Savc\u0131l\u0131k talimat\u0131yla Ka\u00e7ak\u00e7\u0131l\u0131k ve organize Su\u00e7lar \u015eube M\u00fcd\u00fcrl\u00fc\u011f\u00fc ekipleri, C.M.\u2019yi fiziki takibe ald\u0131. A.Y., bir pidecide muhafaza memuru C.M. ile bulu\u015ftu. C.M., iddiaya g\u00f6re odunlar\u0131n iadesi kar\u015f\u0131l\u0131\u011f\u0131nda 500 lira ald\u0131.<\/p>\n<p>Paran\u0131n 100 liral\u0131k b\u00f6l\u00fcm\u00fcn\u00fc A.Y.\u2019ye iade eden C.M. g\u00f6r\u00fcnt\u00fclerin polis kameras\u0131nca kay\u0131t alt\u0131na al\u0131nmas\u0131yla su\u00e7\u00fcst\u00fc yakaland\u0131. \u00c7\u0131kar\u0131ld\u0131\u011f\u0131 Sulh Ceza Hakimli\u011fi\u2019nce tutuklanan C.M. g\u00f6revden uzakla\u015ft\u0131r\u0131ld\u0131. Hakk\u0131nda soru\u015fturma ba\u015flat\u0131lan C.M., Y\u00fcksek Disiplin Kurulu taraf\u0131ndan memuriyetten \u00e7\u0131kar\u0131ld\u0131. Kendisine kumpas kuruldu\u011funu \u00f6ne s\u00fcren C.M., i\u015flemin iptali i\u00e7in \u0130dare Mahkemesi\u2019ne dava a\u00e7t\u0131. Mahkeme, davay\u0131 reddetti. C.M. karara itiraz edince devreye giren B\u00f6lge \u0130dare Mahkemesi, davac\u0131 hakk\u0131nda &#8216;son savunma al\u0131nmad\u0131\u011f\u0131&#8217; gerek\u00e7esi ile istinaf ba\u015fvurusunu kabul ederek \u0130dare Mahkemesi karar\u0131n\u0131 kald\u0131rd\u0131. Bu kez karar\u0131 Orman Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc temyiz etti. Dan\u0131\u015ftay 12. Dairesi, \u0130dare Mahkemesi karar\u0131n\u0131 yerinde bulunca C.M., memuriyetten at\u0131ld\u0131.<\/p>\n<p><strong>\u0130HRACI ONAYLANDI<\/strong><\/p>\n<p>Dan\u0131\u015ftay karar\u0131nda \u015f\u00f6yle denildi: \u201cDaval\u0131 idare taraf\u0131ndan sunulan temyiz dilek\u00e7esi ve eklerin incelenmesinden; davac\u0131 hakk\u0131nda Devlet memurlu\u011fundan \u00e7\u0131karma cezas\u0131 tesis edilmeden \u00f6nce, savunman\u0131n al\u0131nd\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.
