Kirac\u0131lar\u0131n\u0131 tahliye etmek ya da kiray\u0131 y\u00fckseltmek isteyenlerin hukuki yollara ba\u015fvurdu\u011funu belirten avukatlar davalardaki art\u0131\u015fa dikkat \u00e7ekiyor.<\/p>\n<p><strong>\u0130K\u0130 SE\u00c7ENEK VAR<\/strong><\/p>\n<p>H\u00fcrriyet&#8217;in haberine g\u00f6re, kiral\u0131k eve yo\u011fun talep olan bug\u00fcnlerde ev sahipleri iki se\u00e7ene\u011fi de\u011ferlendiriyor. \u0130lki; kiran\u0131n b\u00f6lge ortalamas\u0131n\u0131n alt\u0131nda kald\u0131\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnenler e\u011fer kiralama \u00fczerinden 5 y\u0131l ge\u00e7tiyse \u2018kira tespit davas\u0131\u2019 a\u00e7\u0131p zam talep ediyor. Ev sahibi lehine ikinci se\u00e7enek ise; kira s\u00f6zle\u015fmelerinde 10 y\u0131ll\u0131k s\u00f6zle\u015fme uzama s\u00fcresi dolanlar i\u00e7in tahliye talep ediliyor. Peki yasalar ne diyor? Kanuna g\u00f6re kira s\u00f6zle\u015fmeleri aksi bir i\u015flem yap\u0131lmad\u0131k\u00e7a her y\u0131l yenileniyor. Ancak kiraya veren 10 y\u0131ll\u0131k uzama s\u00fcresinin bitiminden sonra \u2018herhangi bir gerek\u00e7e g\u00f6stermek zorunda olmadan\u2019 kirac\u0131y\u0131 tahliye edebiliyor. Sadece uzama s\u00fcresinin bitiminden en az 3 ay \u00f6nce kirac\u0131ya yaz\u0131l\u0131 olarak fesih bildirimi yapmak zorunda.<\/p>\n<p>Konut kiralar\u0131 zamlar\u0131 T\u00fcrkiye \u0130statistik Kurumu taraf\u0131ndan a\u00e7\u0131klanan 12 ayl\u0131k ortalama T\u00fcketici Fiyat Endeksi\u2019ne (T\u00dcFE) g\u00f6re belirleniyor. M\u00fclk sahibi yasal olarak bu oran\u0131n \u00fczerinde zam yapam\u0131yor. Ancak 5 y\u0131l sonunda kira tespit davas\u0131 a\u00e7abiliyor. Kira tespit davalar\u0131nda m\u00fclk sahibi \u2018kirac\u0131m b\u00f6lge ortalamas\u0131n\u0131n \u00e7ok alt\u0131nda kira \u00f6d\u00fcyor, bunu d\u00fczeltelim\u2019 diyor. Bu durumda kira, emsal kira bedellerine g\u00f6re yeniden belirleniyor.<\/p>\n<p><strong>HAKKAN\u0130YET \u0130ND\u0130R\u0130M\u0130<\/strong><\/p>\n<p>Hem tahliye hem de kira tespit davalar\u0131na yo\u011fun talep oldu\u011funu belirten Avukat Hikmet G\u00fcng\u00f6r, &#8220;Tahliye i\u00e7in 10 y\u0131ll\u0131k uzama s\u00fcresinin bitiminden en az 3 ay \u00f6nceden ihtar \u00e7ekilmesi \u015fart. Kira tespit davalar\u0131nda da hakim eski kirac\u0131n\u0131n hakk\u0131n\u0131 g\u00f6zetiyor. \u00d6rne\u011fin vatanda\u015f 3 bin kira \u00f6d\u00fcyor ama b\u00f6lge ortalamas\u0131 10 bin lira. Hemen kira 10 bin liraya \u00e7\u0131km\u0131yor. Hakim, eski kirac\u0131ya \u2018hakkaniyet indirimi\u2019 yap\u0131yor ve yeni kiraya karar veriyor\u201d dedi.<\/p>\n<p class=\"content-image\"><img decoding=\"async\" src=\"https:\/\/istanbulchannel.net\/wp-content\/uploads\/2021\/09\/ev-sahipleri-daha-yuksek-kira-icin-mahkemeye-kostu.jpg\" alt><\/p>\n<p>10 y\u0131l \u015fart\u0131 d\u0131\u015f\u0131nda kiras\u0131n\u0131 \u00f6deyenlerin keyfi nedenlerle tahliye edilemeyece\u011fini belirten G\u00fcng\u00f6r, &#8220;Ev sahibi kendisinin ya da bakmak zorunda oldu\u011fu ki\u015filerin ihtiyac\u0131 varsa tahliye isteyebilir. \u0130htiya\u00e7 nedeniyle tahliyede evi 3 y\u0131l ba\u015fkas\u0131na kiraya veremez&#8221; dedi.<\/p>\n<p><strong>K\u0130RALAR NEDEN ARTTI?<\/strong><\/p>\n<p>Konut \u00fcretimi yava\u015flay\u0131nca arz sorunu ortaya \u00e7\u0131kt\u0131.<\/p>\n<p>Artan konut kredi faizi nedeniyle orta gelirli vatanda\u015f ev al\u0131m\u0131ndan uzakla\u015ft\u0131, kiraya y\u00f6neldi.<\/p>\n<p>K\u0131s\u0131tlamalar\u0131n gev\u015fetilmesi ile ertelenen d\u00fc\u011f\u00fcnler yap\u0131l\u0131nca kiral\u0131k eve talep artt\u0131.<\/p>\n<p>Hem bu y\u0131l \u00fcniversiteyi kazanan, hem de pandemi nedeniyle evini kapatan \u00f6\u011frenciler ev aray\u0131\u015f\u0131na girdi.<\/p>\n<p>Kimi b\u00f6lgelerde kentsel d\u00f6n\u00fc\u015f\u00fcm nedeniyle evini tahliye eden vatanda\u015f kiral\u0131k eve ge\u00e7ti.<\/p>\n<p>Yabanc\u0131lar ve g\u00f6\u00e7menlerden gelen konut talebi de baz\u0131 il\u00e7elerde etkili oldu.<\/p>\n<p class=\"content-image\"><img decoding=\"async\" src=\"https:\/\/istanbulchannel.net\/wp-content\/uploads\/2021\/09\/ev-sahipleri-daha-yuksek-kira-icin-mahkemeye-kostu-1.jpg\" alt><\/p>\n<p><strong>\u2018O\u011eLUM GELECEK\u2019 BAHANES\u0130 TUTMADI<\/strong><\/p>\n<p>Gayrimenkul Hukuku Derne\u011fi Ba\u015fkan\u0131 Avukat Ali G\u00fcven\u00e7 Kiraz, ilk kez bu denli yo\u011fun tahliye ve kira tespit davalar\u0131 ile kar\u015f\u0131la\u015ft\u0131\u011f\u0131na dikkat \u00e7ekti. Av. Kiraz, \u201cMal sahipleri \u00f6nce \u2018k\u0131z\u0131m, o\u011flum gelecek evden \u00e7\u0131k\u0131n\u2019 yolunu denedi. Ya da yasal oran\u0131n d\u0131\u015f\u0131nda zamlar istedi. Ancak kirac\u0131 haklar\u0131n\u0131 bilince bunlar i\u015fe yaramad\u0131. \u015eimdi gelinen noktada iki se\u00e7enek de\u011ferlendiriliyor. Bunlardan ilki kira tespit davas\u0131. 5 y\u0131l bittikten sonra a\u00e7\u0131labilen kira tespit davalar\u0131n\u0131n bitme s\u00fcresinin 2-2.5 y\u0131l oldu\u011fu bilinmeli. M\u00fclk sahibi dava sonunda b\u00f6lge rayi\u00e7lerinin aynen ge\u00e7erli olaca\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnmemeli. Hakim b\u00f6lge rayi\u00e7lerine bakar ama kirac\u0131 10 y\u0131ll\u0131ktan az ise y\u00fczde 10, 10 y\u0131ldan fazla ise y\u00fczde 20 hakkaniyet indirimi yapabilir\u201d dedi.<\/p>\n<p>Av.Kiraz, tahliyelerdeki 10 y\u0131l kural\u0131n\u0131 ise bir \u00f6rnekle \u015f\u00f6yle anlatt\u0131: 1 Ocak 2021 ba\u015flang\u0131\u00e7la 1 y\u0131l s\u00f6zle\u015fme ile kiraya verilen bir ev i\u00e7in s\u00fcre 31. 12. 2021\u2019de sona erecektir. Bu tarihten sonra da uzama s\u00fcresi ba\u015flar. Uzama s\u00fcresi kanuna g\u00f6re 1 y\u0131ld\u0131r bu 1 y\u0131llar\u0131n toplam\u0131 10 y\u0131l\u0131 ge\u00e7ti\u011fi takdirde mal sahibi 3 ay \u00f6nceden ihtar g\u00f6ndermek \u015fart\u0131 ile kirac\u0131s\u0131n\u0131 hakl\u0131 gerek\u00e7e art\u0131k ileri s\u00fcrmeden tahliye edebilir. 31.12.2021\u2019de sona erecek bir s\u00f6zle\u015fme i\u00e7in uzama 10 y\u0131ll\u0131k s\u00fcre toplam\u0131 31.12.2031 olacakt\u0131r ve mal sahibi en ge\u00e7 31.09.2031\u2019e kadar veya \u00f6ncesinde kirac\u0131n\u0131n eline ge\u00e7ecek \u015fekilde ihtar g\u00f6ndermelidir. 01.01.2032\u2019den itibaren de hakl\u0131 gerek\u00e7e olmadan tahliye davas\u0131 a\u00e7arak tahliyeyi sa\u011flayabilir. 5 y\u0131l s\u00fcreli bir s\u00f6zle\u015fmeniz var ise 10 y\u0131l kural\u0131 5+10 y\u0131l \u015feklinde \u00e7al\u0131\u015facakt\u0131r.
